Mutual Consent Divorce in India: Process, Timeline & Documents

Mutual consent divorce is usually the fastest and least adversarial way for a couple to legally end a marriage in India – but “fastest” is relative, and there is a process to follow correctly.

What Mutual Consent Divorce Requires

Both spouses must agree that the marriage has broken down and that they wish to separate, and must jointly file a petition. This differs from a contested divorce, where one party opposes the separation or its terms.

The General Process

  • A joint petition is filed before the Family Court, along with a settlement covering alimony, custody (if there are children), and division of property.
  • The court typically records statements from both parties.
  • Under the Hindu Marriage Act, there is a statutory cooling-off period between the first and second motions, though courts can waive this in appropriate circumstances.
  • After the second motion, if the court is satisfied the consent is genuine and voluntary, the decree of divorce is granted.

Documents You Will Typically Need

Marriage certificate, proof of address and identity for both spouses, photographs from the wedding, and a draft settlement agreement covering financial and custody terms.

What Can Go Wrong

The most common issue is an incomplete or vague settlement agreement that leads to disputes later – over maintenance, visitation, or property that was not clearly addressed. A carefully drafted settlement prevents this.

When It Is Not So Mutual

If one spouse withdraws consent before the decree is granted, the mutual consent petition can fail, and the matter may need to proceed as a contested divorce. This is why the underlying settlement needs to genuinely work for both sides, not just look agreeable on paper.
